1. Accepting these Terms
These Terms of Use ("Terms") govern your use of thedellaagency.com and the forms, tools, and content on it (the "Site"), operated by The Della Agency (The Paul J. Della Agency, "we," "us," or "our"). By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. You must be at least 18 years old and a U.S. resident to request a quote.
2. About us
The Della Agency is a locally owned insurance agency at 1135 Deer Park Ave, North Babylon, NY 11703, representing Allstate Insurance Company and its affiliates. Our agency is licensed in New York and additional states. Insurance products are not available in every state, and license information is available on request.
3. Quotes and coverage
- A quote is not a policy. Quotes, estimates, savings examples, and price ranges on the Site are for general comparison only. Your actual premium depends on underwriting, the information you provide, and reports the insurer is allowed to use by law.
- No coverage is in force until a licensed agent confirms it in writing and the insurer issues the policy. Submitting a form, calling us, or receiving a quote does not bind coverage.
- Don't cancel your current policy until your new coverage is confirmed in writing.
- Your policy controls. Coverage is subject to the terms, conditions, limits, and exclusions of the policy actually issued. If anything on the Site conflicts with your policy, the policy wins.
- Savings, discounts, and availability vary by state, by insurer, and by applicant.
4. Website content is not advice
Our blog articles, guides, and tools are general educational information about insurance. They are not legal, tax, or financial advice, and they are not a recommendation about your specific situation. Laws and rates change; we update our content but can't guarantee it's always current or complete. For advice about your coverage, talk with a licensed agent.
5. Your submissions
When you submit information through the Site, you confirm that:
- the information is true, accurate, and complete to the best of your knowledge;
- the phone number and email address are your own, or you are authorized to use them and to consent to being contacted at them; and
- you are submitting for yourself or your household, with permission from anyone else whose information you include (such as other drivers).
Giving false or misleading information on an insurance application may be a crime and can lead to denial of a claim or cancellation of a policy.
6. Consent to calls, texts, and email
When you submit a quote form and agree to be contacted, you give The Della Agency your prior express written consent to contact you about your insurance quote and related insurance products and services at the phone number and email address you provided. This includes calls and text messages (SMS/MMS) that may be made with an automatic telephone dialing system or an artificial or prerecorded voice, even if your number is on a federal or state Do Not Call registry. This consent is given only to The Della Agency; we do not share it with or transfer it to anyone else.
- Consent is not a condition of purchase. You can get a quote or buy a policy without agreeing to calls or texts, for example by calling us at (631) 616-8884.
- Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Opt out anytime: reply STOP to any text, tell us on a call, email pdella@allstate.com, or use any other reasonable method. Reply HELP for help. We honor opt-outs promptly and within the time the law requires.
- Number changes: if you change or give up the number you gave us, please let us know so we don't contact the new owner.
7. E-SIGN consent
Under the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN") and New York's Electronic Signatures and Records Act, you agree that clicking a submit button on our forms, together with the consent language shown next to it, is your electronic signature. It has the same legal effect as a handwritten signature. You also agree that we may provide disclosures, notices, and records to you electronically.
- To view and keep electronic records, you need a device with internet access, a current web browser, and a working email address.
- You may request a paper copy of any record at no charge by calling or emailing us.
- You may withdraw your consent to electronic records at any time by contacting us. Withdrawing does not affect the validity of anything you signed before.
8. Acceptable use
You agree not to: submit false information or information about another person without permission; use bots, scripts, or automated tools to submit forms or scrape the Site; try to interfere with, overload, or gain unauthorized access to the Site or its systems; or use the Site for any unlawful purpose.
9. Intellectual property
The Site's text, articles, graphics, logos, and design belong to The Della Agency or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Allstate and related names and logos are trademarks of Allstate Insurance Company. Nothing on the Site grants you a license to use any trademark.
10. Third-party links
The Site links to websites we don't control, including insurer, review, and government sites. We aren't responsible for their content or practices, and their own terms and privacy policies apply.
11. Disclaimers and limits of liability
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including accuracy, availability, merchantability, and fitness for a particular purpose.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim arising from the Site will not exceed $100.
These limits apply only to your use of this website. They do not limit any rights you have under an insurance policy, under New York insurance law, or under any other law that can't be waived. You agree to indemnify us against claims arising from information you knowingly submit falsely or from your misuse of the Site.
12. Dispute resolution and arbitration
Please read this section carefully. It affects how disputes are resolved. It does not apply to disputes about an insurance policy or claim, which are governed by your policy and applicable insurance law.
Talk to us first
Most concerns can be solved with a phone call. Before starting any formal proceeding, you agree to contact us at pdella@allstate.com or (631) 616-8884, describe the issue, and give us 30 days to try to resolve it. Any applicable statute of limitations is tolled during that period.
Individual arbitration
If we can't resolve it, any dispute between you and us arising from your use of the Site, or from calls, texts, or emails we send you based on information you submitted through the Site (including claims under the Telephone Consumer Protection Act or similar state laws), will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. We will pay the AAA fees that the Consumer Arbitration Rules assign to the business, and the arbitrator may award you attorneys' fees where the law allows. The arbitration will take place in Suffolk County, New York, or another location that is reasonably convenient for you, or by phone or video.
Mass arbitration
If 25 or more demands for arbitration raising similar claims are filed by, or with the assistance of, the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules, including its batching procedures, and you and we agree to resolve them in batches.
No class actions
You and we each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or award class-wide relief.
Exceptions
- Either party may bring an individual claim in small claims court if it qualifies.
- Nothing here prevents you from filing a complaint with, or seeking help from, the New York State Department of Financial Services, the Federal Communications Commission, the Federal Trade Commission, a state attorney general, or any other government agency.
Your right to opt out
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing pdella@allstate.com with your name, the phone number or email you used, and a statement that you opt out of arbitration. Opting out doesn't affect any other part of these Terms.
If the class-action waiver is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration. If any other part of this section is found unenforceable, the rest remains in effect. This section survives the end of your use of the Site.
13. Governing law
These Terms are governed by the laws of the State of New York and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. For any matter not subject to arbitration, you agree to the jurisdiction of the state and federal courts located in Suffolk County, New York.
14. General terms and changes
We may update these Terms from time to time by posting a new version with a new effective date. Changes apply from that date forward and do not apply to disputes that arose before the change. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
